General Terms and Conditions (GTC)
for www.eu.algorigin.com (Status: 31.10.2023)
1. Scope of application
These terms and conditions apply to all orders placed through the online store of Algorigin Europe, a company with a share capital of 10,000 euros, whose registered office is located at 57 avenue du Maréchal Juin - 64200 Biarritz - France and whose intra-Community VAT number is FR40830276424 (hereinafter referred to as "Algorigin" or "the seller").
2. Offer and conclusion of contract
- The presentation of products in the online store does not constitute a legally binding offer by Algorigin, but an invitation to the customer to place a binding order (offer to enter into a contract).
- By clicking on the [Buy Now] button, the customer places a binding order for the products shown on the order page.
- Algorigin will acknowledge receipt of the order by e-mail immediately upon receipt. The sales contract is only concluded when the seller confirms dispatch of the goods by e-mail (order or dispatch confirmation) or, at the latest, when the goods are delivered.
- In the case of payment in advance (prepayment), the sales contract is concluded when the seller confirms receipt of payment.
3. Prices
- Prices are in EUR and include all taxes, but exclude shipping costs. They are subject to change. Items ordered are invoiced on the basis of the price in force at the time the order is registered.
- The price is payable in full in a single instalment when the order is placed. All orders are invoiced and payable in EUR. For deliveries outside France, any customs duties or local taxes are the responsibility of the recipient.
4. Availability
Products are offered for as long as they are visible on the www.eu.algorigin.com website. In the event of product unavailability after an order has been placed, the customer will be informed by email.
5. Terms of payment
The customer may pay for his order :
- by credit card in the Shopify Payments environment without opening an account and in a secure manner.
- by Paypal account.
6. Reservation of ownership
The goods remain the property of the seller until full payment has been received. It is forbidden to pledge, assign by way of security, transform or modify the goods without the seller's consent prior to transfer of ownership.
7. Warranty
- The seller guarantees the elimination of defects in the goods. He may, at his option, eliminate a defect (repair) or deliver something free of defects (replacement delivery).
- In the event of failure to remedy a defect, the customer is entitled to withdraw from the contract. This does not apply to insignificant defects. The customer is not entitled to a price reduction.
8. Liability
The seller is not liable for slightly negligent breaches of contract. The same applies to breaches of contract committed by auxiliaries and sub-agents.
9. Intellectual property rights
All elements of the www.eu.algorigin.com website are and remain the exclusive intellectual property of Algorigin Europe. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or audio. Any simple link or hypertext link is strictly forbidden without the express written consent of Algorigin Europe.
10. Data protection
The seller undertakes to handle customer data in compliance with data protection regulations. Further information on the processing of customer data can be found in the separate data protection declaration of the seller. This can be consulted at any time on the website Personal data management policy and cookies.
11. Archiving
- Algorigin will archive order forms and invoices on a reliable and durable medium constituting a true copy.
- The computerized records at Algorigin will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.
12. Applicable law
The language of this contract is French. These terms and conditions of sale are governed by French law. In the event of a dispute, the French courts shall have exclusive jurisdiction.
13. Final provisions
The ineffectiveness of any provision of these terms and conditions shall not affect the validity of the contract. The ineffective provision is replaced by the relevant legal provisions.
